If it becomes necessary to use your personal data for a new purpose, we will inform you and convey the legal basis that permits us to do so before initiating any new processing.
6. DATA SHARING
Why might you share my personal data with third parties?
We will share your personal data with third parties when required by law, when it is essential to manage the relationship between us, or when we have another legitimate interest in doing so.
Which third-party service providers process my personal data?
"Third parties" refers to third-party service providers or other members of our firm’s network. The following activities are performed by third-party service providers: IT and cloud services, professional advisory services, administrative services, marketing services, and banking services.
All our third-party service providers are required to implement commercially reasonable and appropriate security measures to safeguard your personal data. We only allow our third-party service providers to process your personal data for specified purposes and in line with our directives.
What about other third parties?
We may share your personal data with additional third parties, for example, in the context of a potential sale or restructuring of the business. We may also need to share your personal data with a regulator or to comply with legal obligations.
7. TRANSFERRING PERSONAL DATA OUTSIDE THE EUROPEAN ECONOMIC AREA (EEA)
There may be instances where personal data is transferred to, and processed in, countries outside of the European Economic Area (EEA), such as to certain IT and cloud service providers.
When your data is transferred outside of the EEA, we will ensure that adequate safeguards are in place to protect your data. This will include incorporating the European Commission’s Standard Contractual Clauses in agreements with third parties or, for transfers to US-based third parties, ensuring the entity is Privacy Shield certified.
8. DATA SECURITY
We have implemented commercially reasonable and suitable security protocols to avert your personal data from being unintentionally lost, misused, or accessed in an unauthorized manner, modified, or disclosed. Additionally, we restrict access to your personal data to those employees, agents, contractors, and other third parties who have a professional necessity to know. They will only process your personal data under our direction, and they are obliged to maintain confidentiality.
We have established procedures to address any suspected data security incidents and will inform you and any relevant regulator of a suspected breach where we are legally obligated to do so.
9. RIGHTS OF ACCESS, CORRECTION, ERASURE, AND RESTRICTION
Your obligation to inform us of modifications
It is crucial that the personal data we possess about you is precise and up-to-date. If your personal information changes, please inform us of any modifications that we need to be aware of by contacting us using the contact information provided below.
Your rights related to personal data
Under specific conditions, by law you have the right to:
Request access to your personal data. This allows you to receive details of the personal data we have about you and to verify that we are processing it lawfully.
Request correction of the personal data that we hold regarding you.
Request erasure of your personal data. This allows you to request that we delete or eliminate personal data when there is no valid reason for us to continue processing it. You also have the right to request deletion or elimination of your personal data if you have exercised your right to object to processing (see below).
Object to processing of your personal data when we are relying on a legitimate interest (or those of a third party) and there is something about your specific situation that makes you want to object to processing on this basis. You also have the right to object if we are processing your personal information for direct marketing purposes.
Request the restriction of processing of your personal data. This enables you to ask us to pause the processing of personal data about you, for instance, if you want us to verify its accuracy or the rationale for processing it.
Request the transfer of your personal data to you or another data controller if the processing is based on consent, performed by automated means and is technically feasible.
If you wish to exercise any of the above rights, please email our data protection point of contact: hello@brownsaccounting.uk
You will not be charged a fee to access your personal data (or to exercise any of the other rights). However, we may impose a reasonable fee if your request for access is clearly unfounded or excessive. Alternatively, we may refuse to comply with the request under such circumstances.
We may need to request specific information from you to assist us in confirming your identity and ensuring your right to access the information (or to exercise any of your other rights). This is another appropriate security measure to ensure that personal information is not disclosed to anyone who does not have the right to receive it.
10. RIGHT TO WITHDRAW CONSENT
In the limited situations where you may have given your consent to the collection, processing, and transfer of your personal data for a specific purpose (for example, regarding direct marketing that you indicated you would like to receive from us), you have the right to withdraw your consent for that specific processing at any time. To withdraw your consent, please email our data protection point of contact: hello@brownsaccounting.uk
Once we have received notification that you have withdrawn your consent, we will cease processing your personal information (personal data) for the purpose or purposes you initially agreed to, unless we have another legitimate basis for doing so legally.
